Having your land demarcated has a cost, but it is a very small investment compared to the purchase of your land or your house that will allow you to sleep soundly for years to come! 

The price of a land demarcation by a surveyor varies between 500 and 1,500 euros on average depending on the difficulty of the demarcation, the size of the land and the number of markers to be placed (2 markers, 4 markers or more).

• From an amicable demarcation: you and your neighbour agree on the dividing limits of your land, the surveyor will draw up a report to give a contractual value to the demarcation.
  
  
• From a legal boundary (disagreement on the dividing line or refusal to perform an amicable demarcation): one of the owners then grabs the judge to compel his neighbour to pay part of the costs.

Article 646 of the Civil Code provides that where the demarcation of the request is made by a neighbour, the costs are shared. However, case law shows that the reality is often more complicated :

Here, they are two neighbours, the first of which asks the second for an amicable demarcation. The second neighbour refuses. Instead of asking for a legal demarcation, the first neighbour persists and calls in a surveyor anyway. The latter draws up a report which he has signed by both parties. The first neighbour then comes to demand from the second neighbour to partially reimburse the surveyor's fees. The second neighbour refuses, the case ends in court and the Court of Cassation finally decides in favour of the second neighbour! Indeed, the Court considers that Article 646 of the Civil Code should apply only if two parties agree on the boundaries of the land, in the event of disagreement, the neighbour who is at the origin of the demarcation request must request a judicial demarcation. If he doesn't, it's up to him to assume all costs alone. In this practical case, the first neighbour unilaterally made all the decisions without listening to his neighbour and also tried to mislead the surveyor into expanding his land.
